Calibration Service Consent: By acknowledging this disclaimer, you hereby consent to engaging Dan Tuned as your expert in calibration for your vehicle. Dan Tuned reserves the right to terminate the calibration service without refund if necessary action items for the calibration service are not heeded to, addressed, or followed up on.

Customer Responsibility: It is the customer’s responsibility to ensure that the vehicle is ready for calibration services. While we are available to help mitigate minor challenges unrelated to calibration service, it’s important to note that our services are focused on tuning and do not include repairs. Please reach out to us in advance if unsure if your vehicle is ready.

Off-Road/Off-Highway/Competition Use: Dan Tuned services are for off-road/off-highway/competition use only. Any modifications may impair your vehicle’s emission control system performance. These modifications shall not be used on any street or highway. Such modifications may void factory warranties on street vehicles, violate state and federal emissions laws, and may not be CARB/EPA certified.

No Warranty for Calibration Services: Dan Tuned does not provide or imply a warranty for any calibration services. We are not responsible for mechanical failures or damage to parts on the vehicle. Replacement of parts is at the customer’s expense. Your car will be calibrated for competition use only, and you agree to use Dan Tuned’s services at your own risk. All services are provided ‘as-is’ without any express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.

Disclaimer of Liability: You, the customer, acknowledge that any risk of personal injury, mechanical failure, or damage to the vehicle is your responsibility. You agree to indemnify, defend, and hold harmless Dan Tuned, its owners, employees, and representatives from any and all claims, demands, losses, damages, liabilities, legal fees, or expenses (including attorney’s fees) arising from or related to: 1) The use or misuse of the services or equipment provided by Dan Tuned 2) Any third-party claims or legal actions arising from modifications or calibrations performed. 3) Any damages or losses, whether or not caused by Dan Tuned’s negligence. This indemnification extends to any fines, settlements, judgments, taxes, or legal costs incurred in connection with the services provided. It is not contingent on any recovery from an insurance policy.

No Self-Reprogramming of PCM: You acknowledge that the calibration provided by Dan Tuned does not expire or alter after a period of time without external intervention. If your vehicle performs well post-calibration but later experiences issues, you understand that such issues are likely hardware related, and the calibration is not the cause. It is your responsibility to address and resolve any hardware related concerns through appropriate automotive diagnostics and repairs.

Service Window Policy: Tuning services are valid for 30 calendar days from the delivery of the base file. If no progress is made within this period due to lack of client communication or unresolved vehicle issues, the session will be closed. Continued support after that point will require a new calibration request and payment.

Refund Policy: All sales are final. Calibrations are digital intellectual property and, once delivered, are non-refundable and non-transferable.

Assumption of Risk: By engaging our services, you acknowledge and assume all risks associated with high-performance tuning, including the potential for voided warranties, emissions violations, increased wear, or catastrophic mechanical failure.
